Biguests is a software-as-a-service (SaaS) platform that helps small and medium-sized businesses manage customer relationships, foot traffic, and loyalty programs. The Service allows businesses ("Customers") to build customer databases, send automated digital gifts, coupons, and communications, and access engagement analytics.

To use the Service, you must be at least 18 years old and have the authority to bind your business to these Terms. You agree to provide accurate, current, and complete information when creating an account and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Biguests offers subscription plans organized into tiers based on factors such as the size of your contact database. By subscribing, you authorize us (or our designated payment processor) to charge your chosen payment method on a recurring basis according to the plan you select. Subscription fees are billed in advance and are non-refundable except as described in our Refund Policy.

If your usage exceeds the limits of your current plan, your subscription may be automatically upgraded to the next applicable tier, and billing will be adjusted accordingly. You will be notified of any such changes.

As part of using the Service, you may upload, store, or process personal information about your own customers ("End-User Data"), such as names, email addresses, and visit history. You represent and warrant that you have all necessary rights and consents to collect, share, and process this End-User Data through Biguests, and that your use of the Service complies with applicable data protection laws.

You remain the data controller for End-User Data. Biguests acts as a data processor and will handle End-User Data only as necessary to provide the Service, in accordance with our Privacy Policy.

You agree not to use the Service to:

• Send unsolicited communications, spam, or content that violates anti-spam laws such as the CAN-SPAM Act.
• Upload or distribute content that is unlawful, fraudulent, defamatory, or infringes on the rights of others.
• Attempt to gain unauthorized access to the Service, other accounts, or related systems.
• Use the Service in any way that could disable, overburden, or impair its functionality.

We reserve the right to suspend or terminate accounts that violate this section.

Biguests and its licensors retain all rights, title, and interest in and to the Service, including all software, designs, trademarks, and content provided by us. These Terms do not grant you any ownership rights in the Service. You retain all rights to the content and data you upload, subject to the license you grant us to operate the Service on your behalf.

We strive to keep the Service available and operational at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

You may cancel your subscription at any time through your account settings. We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or for other reasons at our discretion, with notice where reasonably possible.

To the maximum extent permitted by law, Biguests shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles.
